Welcome to Day 3 and…

This was supposed to be a parade of relatively predictable witnesses, but the Democrats apparently had something up their sleeve. Some people thought the Democrats should just take their ball and bat and walk out of the hearings. Personally, I thought it was better to stay and build the case against Kavanaugh by sticking to the process and meticulously building the case of GOP malfeasance through the hearings. Senator Leahy did exactly this when he straight up tricked Kavanaugh into admitting to the existence of emails that have no conceivable national security or confidentiality issue but are nonetheless designated confidential by Grassley under the time-honored standard that “confidential” means “looks bad for the nominee.” Words have meaning in textualism!
Well, that set the table and Cory Booker came in this morning with the feast, declaring that he’s going to violate the committee confidential process and risk censure or worse by leaking confidential documents about Kavanaugh’s views on racial profiling that had been marked as off-limits for public consumption. And that’s when the rest of the Democrats joined in and… well here we go!
