This essay draws upon the author’s experience as a prosecutor at the Guantánamo Bay Military Commissions and provides commentary on the troubled terrorism courts. The essay is both a reflection piece and an introduction for readers to various issues, including: the public perception of the commissions, the potential legacy, the role of the prosecution and defense, and current legal struggles. Calls for the demise of the military commissions are frequent, but so far premature. Ultimately, it is uncertain when, if ever, the process will come to a successful conclusion.
